    Housing Discrimination - Fair Housing

    The Fair Housing Act protects people from discrimination when they are leasing or purchasing a home, getting a mortgage, looking for housing support, or engaging in other housing-related activities.

    Fair Housing Information

    Find information below on who and what is covered under the law.

    The Fair Housing Act forbids discrimination in housing due to the fact that of:

    - Race.
    - Color.
    - National Origin.
    - Religion.
    - Sex.
    - Familial Status.
    - Disability.
    What Is Prohibited?

    In the Sale and Rental of Housing:

    It is illegal discrimination to take any of the following actions due to the fact that of race, color, religion, sex, special needs, familial status, or nationwide origin:

    - Refuse to rent or sell housing.
    - Refuse to work out for housing.
    - Otherwise make housing unavailable.
    - Set various terms, conditions or opportunities for sale or leasing of a residence.
    - Provide an individual various housing services or centers.
    - Falsely reject that housing is offered for inspection, sale or rental.
    - Make, print or publish any notice, statement or advertisement with regard to the sale or leasing of a residence that suggests any preference, limitation or discrimination.
    - Impose different list prices or rental charges for the sale or rental of a dwelling.
    - Use different qualification criteria or applications, or sale or rental standards or procedures, such as earnings standards, application requirements, application charges, credit analyses, sale or rental approval procedures or other requirements.
    - Evict a tenant or an occupant's guest.
    - Harass a person.
    - Fail or hold-up efficiency of upkeep or repair work.
    - Limit privileges, services or centers of a residence.
    - Discourage the purchase or leasing of a dwelling.
    - Assign an individual to a specific structure or community or area of a structure or community.
    - For revenue, encourage, or attempt to convince, homeowners to sell their homes by suggesting that people of a specific protected quality will move into the community (blockbusting).
    - Refuse to supply or discriminate in the terms or conditions of house owners insurance due to the fact that of the race, color, religion, sex, impairment, familial status, or national origin of the owner and/or residents of a residence.
    - Deny access to or membership in any numerous listing service or realty brokers' organization.
    In Mortgage Lending:

    It is prohibited discrimination to take any of the following actions based on race, color, religion, sex, disability, familial status, or national origin:

    - Refuse to make a mortgage loan or supply other monetary assistance for a home.
    - Refuse to offer details regarding loans.
    - Impose various terms or conditions on a loan, such as various rate of interest, points, or charges.
    - Discriminate in appraising a dwelling.
    - Condition the availability of a loan on an individual's action to harassment.
    - Refuse to purchase a loan.
    Harassment:

    The Fair Housing Act makes it illegal to harass persons since of race, color, religious beliefs, sex, special needs, familial status, or national origin. Among other things, this forbids unwanted sexual advances.

    Retaliation and Other Prohibitions:

    It is unlawful discrimination to:

    - Threaten, push, daunt or hinder anyone exercising a reasonable housing right or helping others who exercise the right.
    - Retaliate against a person who has actually filed a reasonable housing problem or assisted in a fair housing examination.
    Reasonable Accommodations and Reasonable Modifications

    Under the Fair Housing Acts a reasonable lodging is a change, exception, or adjustment to a guideline, policy, practice, or service. The Fair Housing Act makes it illegal to refuse to make sensible accommodations to guidelines, policies, practices, or services when such accommodations may be required to pay for individuals with disabilities an equal chance to utilize and enjoy a house and public and common usage areas.

    In addition, the Fair Housing Act prohibits a housing company from declining to allow, at the expense of the individual with a disability, affordable adjustments of existing premises inhabited or to be inhabited by such individual if such adjustments may be required to pay for such individual complete satisfaction of the facilities.

    What is Needed for a Grievance

    To send a housing discrimination grievance these requirements should be satisfied:

    - The residential or commercial property must be within the state of Texas.
    - The residential or commercial property owner, in the majority of cases, should have more than three residential or commercial properties. This does not consist of multi-family houses.
